By engaging Western Cloud Solutions (Pty) Ltd ("Western Cloud"), accepting a quotation, making payment, or using our services, you agree to the following Terms & Conditions.

Services

Western Cloud provides services including website design and development, website hosting, domain management, cloud services, digital marketing, graphic design, software development, CRM implementation, and related consulting services.

Payments

Unless otherwise agreed in writing, project work is payable upfront and monthly services are billed in advance.

Invoices must be paid on or before the due date. Western Cloud reserves the right to suspend services for overdue accounts.

Debit Orders

Clients paying via debit order authorize Western Cloud to collect agreed amounts from their nominated bank account.

A failed debit order fee of R150.00 will be charged for each unsuccessful debit order attempt. Repeated failed debit orders may result in service suspension or termination.

Cancellations

Clients with signed contracts are subject to the cancellation terms contained within their agreement.

Clients without a signed contract must provide one (1) full calendar month's written notice of cancellation. Charges remain payable during the notice period.

Projects and Delays

Project timelines are dependent on the Client providing content, approvals, feedback, and required information.

Western Cloud is not responsible for delays caused by late content, delayed approvals, lack of communication, or changes requested by the Client.

A project will be considered substantially complete once the agreed work has been completed and is awaiting launch approval, content, feedback, or instructions from the Client.

Dormant Projects

Projects that remain inactive for more than ninety (90) consecutive days due to a lack of response, content, approval, or instructions from the Client may be archived.

A backup of the project may be provided to the Client, who will have seven (7) calendar days to download and secure the files.

Western Cloud is not obligated to retain project files, backups, source code, databases, designs, or assets after this period and accepts no liability for files that are subsequently removed from its systems.

Refunds

All payments for website design, development, graphic design, marketing implementation, consulting, setup, configuration, and professional services are non-refundable once work has commenced.

Clients are paying for professional time, expertise, planning, design, development, and implementation services performed by Western Cloud.

Website Transfers and Migrations

Should a Client move to another provider, Western Cloud will provide the necessary files, backups, credentials, or access through its client portal or approved delivery method.

It is the responsibility of the receiving provider to complete the migration.

If migration assistance is required from Western Cloud, a compulsory minimum charge equivalent to two (2) hours labour will apply regardless of the size of the project. This fee must be paid before assistance is provided.

Additional time exceeding the initial two hours will be billed at Western Cloud's standard hourly rate.

All outstanding invoices must be paid in full before any website transfer, migration, domain transfer, backup release, or handover will be processed.

Limitation of Liability

Western Cloud shall not be liable for indirect, consequential, or incidental damages, loss of profits, loss of data, business interruption, or third-party service failures.

Privacy

Western Cloud processes personal information in accordance with applicable South African legislation, including POPIA. By using our services, you agree to our Privacy Policy.

Amendments

Western Cloud reserves the right to update these Terms & Conditions at any time. Updated versions will be published on our website.
